4. Hyperlinking to the Site

We grant you limited and revocable permission to create a hyperlink to the home page of this Site provided that: (i) the hyperlink does not portray Telagento or our services in a false, misleading, derogatory, or otherwise offensive manner; (ii) your linking website complies with all applicable laws and does not violate the rights of others; and (iii) your linking website maintains a privacy policy no less protective than ours. We may revoke this permission at any time with or without cause. You may not use any Telagento logos, trademarks, or proprietary graphics as part of the hyperlink without our express written permission.

5. AI Services Disclaimer

Telagento provides AI Agent services that produce outputs based on machine learning models. You acknowledge and agree that:

  • AI-generated outputs may be inaccurate, incomplete, biased, or unsuitable for a particular purpose;
  • You are solely responsible for reviewing, validating, and acting upon any AI-generated output;
  • Telagento does not warrant that AI outputs are error-free, factually accurate, or fit for any specific use;
  • Human oversight of AI outputs is required, particularly for decisions affecting individuals' rights, health, safety, or finances.

6. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. TELAGENTO DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TELAGENTO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ITS CONTENT, EVEN IF TELAGENTO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL TELAGENTO’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE AMOUNT YOU PAID TELAGENTO IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Telagento and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (i) your use of the Site, including any content contained or available therein; (ii) your violation of these Terms of Use; and/or (iii) your violation of any rights of any third party.

9. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by Telagento. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to review the terms and privacy policy of any third-party site you visit. Telagento shall not be liable for any damages arising from your use of or reliance on any third-party content, products, or services.
